Please see below some questions that you may have about Family Mediation and Parenting Plans:

What is Family Mediation?

Family Mediation is a confidential and non-adversarial process that intends to help divorcing and separating couples reach agreements on all issues relating to their separation. It is often the preferred choice for couples wishing to avoid the timely, costly, and emotionally draining process of litigation (family court).

What is a Parenting Plan?
A parenting plan is a comprehensive agreement that outlines how you will co-parent your child/children once you are separated or divorced. It answers questions about parenting time and a child/children's living arrangements.

A parenting plan typically includes:

  1. Details about the living arrangements for minor children including days per week (or hours per day) each parent has rights or responsibilities

  2. Decision making regarding the children’s education, health care, and religious upbringing.

  3. Daily and weekly schedules regarding school and extracurricular activities and holidays.

Why Mediate Your Parenting Plan?
It is important to establish a schedule as part of mediating a parenting plan. Even after your separation or divorce is finalized, you and your former partner will still be engaged and need to work together in raising your child or children.

While you are mediating your parenting plan, I will teach you both how to anticipate where conflicts could arise when raising your child/children and work with you both to proactively address these concerns so that you and your former partner's working relationship as parents can be protected.

Mediating a Parenting Plan is an effective strategy that benefits you both as parents. Mediation can help to

  1. Reduce conflict between you and your former spouse now and in the future

  2. Develop or enhance a positive ongoing co-parenting relationship that benefits the kids as well

  3. Support the mental, social and emotional health of your child/children

What happens after the Parenting Plan has been mediated?

The Parenting Plan is part of your Separation Agreement document. Once the Parenting Plan has been agreed on, you and your former partner will need to seek independent legal advice to assist with adding the Parenting Plan into the Separation Agreement document. The Separation Agreement document can be filed in Family Court which would make your Separation Agreement legally binding
